REDDING, California -- A lawsuit against the city of Redding and a former police officer for the city, Jacob Provencio, is now set to move toward a jury trial.
The lawsuit from Redding resident Rebecckah McClelland centers around the alleged inappropriate actions taken by Provencio during a traffic stop, who at the time was known as one of the top DUI officers for the city.
The incident allegedly occurred on Aug. 6, 2020, after McClelland was pulled over after leaving The Hen House in Redding. The suit alleges Provencio and an unnamed officer inappropriately frisked McClelland several times despite her requests for a female officer. It goes on to allege that after officers determined she was under the influence Provencio put her under arrest. Allegedly injuring her arm and rib cage in the process, the suit also claimed he took the opportunity to feel McClelland up when putting her in the squad car.
The suit alleged that he not only abused McClelland but gained sexual pleasure from doing so. Provencio allegedly followed up with a text and voicemail to McClelland's phone following the incident. The suit goes on to claim an internal investigation was performed, over the next year, and in 2022 it found Provencio at fault for improper conduct during the stop, which inspired McClelland to move forward with the lawsuit in August of 2022.
After several years of pre-trial hearings, a jury trial has been set for July 2025. The deadline for filing dispositive motions was set for January 31, 2025.
Provencio's last day working for the city was in May of 2023, although it is not clear if he was let go or left of his own volition. Two other lawsuits against Provencio have cost the city just over $140,000.
However, McClelland is asking for 5 million in damages. As of Monday afternoon, neither she nor the city's attorneys replied to requests for comment.
