A New York judge has dismissed a civil lawsuit filed against Sean "Diddy" Combs, which accused the music mogul of sexual assault. The case, brought by Houston attorney Tony Buzbee on behalf of a plaintiff identified as John Doe, was thrown out because it was filed after the statute of limitations had expired.
According to a report from TMZ, the lawsuit claimed the plaintiff, an up-and-coming 23-year-old artist at the time, was allegedly drugged and sexually assaulted by Combs at an L.A. nightclub in 2015. The lawsuit stated that the plaintiff fell unconscious after being given a drink and woke up to "unwanted sexual contact" from Combs. He also claimed that Combs threatened his career if he resisted.
However, the New York judge ruled that the plaintiff waited too long to file the case. At the time of the alleged assault, the statute of limitations was five years. The judge noted that a new law passed in 2019 that extends the statute to 20 years is not retroactive, and therefore did not apply to this case.
Lawsuits against Diddy's companies, Bad Boy Entertainment and Combs Enterprises, were also dismissed. The dismissal marks another legal victory for Combs, who has recently had a few other civil lawsuits against him thrown out. This legal win comes as the music mogul is currently in jail awaiting sentencing in his federal criminal case, which is scheduled for October 3. Dozens of other civil lawsuits against Combs remain active.
