Wrongful death lawsuit filed after crash left 3 Upstate students dead

A wrongful death lawsuit has been filed after a crash left three high school students in Spartanburg County dead.(Video above: Previous Coverage)The crash happened on Sept. 29, 2023, on Fairfield Road near Henderson Road in Chesnee. The coroner said the crash resulted in the deaths of three students: Jeffrey Scott Wallace, 18, Vladimir Matthew Rybinski, 17, and Vitaliy Gregoriy Rybinski, 15. Officials said a Lexus sedan with a driver and three passengers was headed east on Fairfield Road when a 1999 Ford F-150 truck began backing onto Fairfield Road from a driveway.According to reports, due to the Lexus' rate of speed, the vehicle swerved off the left side of the road, striking a mailbox, then fell into a ditch and overturned. The vehicle caught fire, and the three teens died.The driver and survivor of the Lexus, Juan Ortega Preciado, was charged in January with three counts of reckless homicide in the crash and driving without a license.A representative of Vitaliy Rybinski is suing Preciado, his family and the driver of the Ford, who backed out of the driveway.The lawsuit alleges that the crash, injuries and death of Vitaliy Rybinski and damages to his mother and statutory heirs are the direct result of willful, reckless, grossly negligent and careless acts of the defendants. Additionally, the lawsuit alleges that Preciado's family allowed him to drive the vehicle when the family knew he did not have proper training or a valid driver's license.The representative for Vitaliy Rybinski is asking for an award of actual damages along with consequential and punitive damages in an appropriate amount to be determined by the court.
